A Data Access and Use Agreement
A Data Access and Use Agreement (DAUA) is a legal contract between two entities that governs a data-sharing arrangement between those entities. This DAUA defines the data to be shared, the purpose for which the data is to be shared, the period during which the data is to be shared, and any limitations or protocols that must be observed by the recipient of the data during and after the data-sharing arrangement. Examples of limitations include restricting the purpose for which the shared data can be used, the deidentification of certain data and the destruction of certain data after the data-sharing period has concluded.
This DAUA template is for situations in which UNSW staff require a data sharing arrangement with an external party. This DAUA template should only be used for non-commercial purposes and when:
- UNSW will be giving an external third-party data or access to data; or
- UNSW will be receiving data or access to data from an external party.
Research Grants and Contracts can assist with preparing the DAUA. The Director of Research Grants and Contracts would typically execute a DAUA related to a research project. Where the DAUA concerns sharing data with an industry partner in anticipation of commercial business opportunities the Director, Business Development & Commercialisation can execute the agreement.
